Ongoing - Full-time, Part-time Position Overview As the Manager (Arbitration) you will support the Director, Dispute Resolution & Assistance managing a team of case management staff involved in a range of dispute resolution activities relevant to the right to negotiation provisions of the Native Title Act 1993 (Cth). The role requires coordinating and leading the NNTT’s arbitral functions and activities. In particular, this means providing legal and policy support to the Director, Dispute Resolution & Assistance in relation to the NNTT’s arbitral functions, practice and procedure, as well as on individual cases and stakeholder capability and engagement.The position requires strong people management and leadership skills, with an emphasis on capacity-building and policy development. Alongside the coordination of activities in support of the NNTT’s arbitral functions, the role contributes to the NNTT’s case management practices and provides expert advice to inform the strategic direction of the Dispute Resolution & Assistance Team. Consultation and collaboration with the NNTT’s leadership group and Tribunal Members is a key requirement of the role’s internal engagement activities, as well as liaison with the President and Registrar on relevant issues.Key Duties and Responsibilities Coordination and Work Allocation: Coordinate and manage the allocation of arbitral matters within the Dispute Resolution team, including future act and other native title inquiries, ensuring the effective delivery of case management support and dispute resolution service to achieve organisational objectives. People Management and Development: Define and supervise performance and development objectives for staff, delegate responsibilities, set priorities and conduct annual performance evaluations within the Dispute Resolution & Assistance team; develop team capability through advice, coaching and formal performance appraisals and work with the Director, Dispute Resolution & Assistance to foster a multi-disciplinary ‘community of practice’. Planning and Excellence: Collaborate with the Director, Dispute Resolution & Assistance to develop and coordinate the strategic direction of the work area in the context of long-term and organisational planning objectives; identify and implement change and business improvement strategies, including by leading the consolidation and maintenance of policies, procedures, and guidelines; and demonstrate leadership in fostering a culture of excellence. Internal and external relationships: Build productive working relationships with the Tribunal President and Members NNTT and the Registrar in support of the NNTT’s arbitral functions and collaborate with senior management to build and sustain constructive working relationships with external stakeholders in the context of broader dispute resolution activities. Business Innovation: Foster an agency-wide community of knowledge and practice about case management and arbitration, particularly in the context of future act inquiries; in collaboration with the Director, Dispute Resolution & Assistance, and the Manager (Mediation) review, develop and maintain case management and workflow tools and systems to improve performance, enhance capabilities and meet statutory obligations. Legislative Compliance: Monitor compliance with internal policies relating to the NNTT’s arbitral functions; identify gaps in practice and procedures; and ensure policies are up-to-date and consistent with the Native Title Act 1993 (Cth) and regulations and principles of administrative law and public administration; exercise general oversight of performance standards and consistency of practice within the Dispute Resolution & Assistance team. Legal Support: Provide expert legal support to the Director, Dispute Resolution in relation to the NNTT’s arbitral functions, practice, and procedures and on individual matters, as required; participate in complex and/or sensitive dispute resolution activities in support of the NNTT’s statutory functions. Public Administration: Adhere to the Australian Public Service Values and Code of Conduct, including the ability to operate as an effective and impartial representative of the Tribunal. Note : Tasks and duties of the role may change from time to time, subject to operational needs. Some travel will be required, possibly to remote locations.$110,115 - $120,025 per annum, plus 15.4% superannuation Ongoing - Full-time, Part-time Brisbane, Cairns, Perth Qualifications/demonstrated experience in one of the following: • Legal qualifications, admission as a legal practitioner, or the eligibility to be admitted.• Mediation training and/or accreditation.Selection Criteria Possessing and demonstrating an understanding of the issues affecting, and the ability to communicate sensitively and effectively with, Aboriginal and Torres Strait Islander people. Knowledge of the Native Title Act 1993 (Cth) and the operating context of the NNTT, or the ability to quickly acquire it, and principles of administrative law, dispute resolution and case management practice. Well-developed project management and legal research skills, with the requisite written communication skills and ability to develop, maintain, interpret, and apply policies and procedures within a legislative framework. Demonstrated ability to operate under broad direction while exercising a considerable degree of independence and initiative; respond constructively to a changing environment; generate new ideas, approaches, and strategies; assess risks and solutions to achieve positive improvements and outcomes. High-level communication and interpersonal skills, including the ability to lead and motivate team members and constructively engage with and influence peers. Eligibility Employment with the Court is subject to the conditions prescribed in the Public Service Act 1999, and the following:Australian citizenship – the successful applicant must hold Australian citizenship.
