This role is focused on providing legal advice and expertise on financial services regulation, ensuring compliance with the Australian financial services regulatory framework, and advising on key regulatory and compliance matters. The successful candidate will have a strong understanding of Australian financial law, including the Corporations Act, ASIC regulatory guidelines, regulatory investigations and litigation. Key Responsibilities: Regulatory Compliance: Provide legal advice and strategic guidance on financial services regulatory issues, including compliance with Australian Securities and Investments Commission (ASIC) and Australian financial laws such as the Corporations Act and other relevant financial regulations. Regulatory Risk Management: Identify, assess, and mitigate legal risks associated with all operational units of the organisation. Licensing and Authorisations: Advise on licensing requirements, applications, and ongoing compliance with financial services licensing obligations. Legal Support for Financial Products: Provide legal support and advice on the development, distribution, and management of financial products and services. Investigations and Enforcement: Represent the organisation in regulatory investigations and proceedings and manage external counsel as required. Corporate Governance and Compliance: Advise on governance and compliance obligations. Training and Awareness: Conduct internal training sessions for the business on financial services regulations, including updates to regulatory frameworks, compliance best practices, and emerging trends in financial services law. Regulatory Reporting: Ensure timely and accurate regulatory filings, disclosures, and reports are made in compliance with Australian financial services regulatory requirements. Key Requirements: Qualifications: Australian legal qualification (Bachelor of Laws or equivalent). Admission to practice as a lawyer in Australia. Post-graduate qualifications in Financial Services Law, Regulatory Law, or related fields (desirable). Experience: At least 5 years’ experience as a lawyer specialising in financial services regulation, with a solid understanding of the regulatory environment and legal frameworks in the Australian financial sector. Experience gained in-house within a regulatory context, with prior training at a leading Australian or international law firms that advise financial services clients is highly advantageous. Experience in handling regulatory investigations, enforcement actions, and disputes within the financial services sector. Experience with financial services licensing, compliance programs, and risk management. In-depth knowledge of the Australian financial services regulatory environment. Strong analytical, drafting, and problem-solving skills, with the ability to interpret complex financial regulatory issues and provide clear, actionable legal advice. Excellent written and verbal communication skills, with the ability to communicate complex legal concepts to business stakeholders in an understandable and practical manner. Ability to manage multiple projects simultaneously, prioritising and delivering under tight deadlines.
